Electronic Cigarettes Act (ECA) and changes to the Smoke-Free Ontario Act (SFOA)
Kingston – There are new rules for selling electronic cigarettes (e-cigarettes) under Ontario’s new Electronic Cigarettes Act (ECA).
As of January 1, 2016, the ECA states that it is illegal to:
- sell or supply e-cigarettes and their component parts (e.g., battery, atomizer) to anyone under 19 years of age.
Business owners are responsible for ensuring compliance with the law.
There have also been changes to the Smoke Free Ontario Act (SFOA).
As of January 1, 2016, changes to the SFOA include:
- banning smoking on outdoor grounds of hospitals, psychiatric facilitates and buildings owned by the Province, except where a designated smoking area is available.
- banning the sale of flavoured tobacco products, with certain exemptions.
